Phillip Phillips is the new 'American Idol'

LOS ANGELES (AP) ? Phillip Phillips, a bluesy Georgia guitar man, was crowned the new "American Idol" on Wednesday after defeating teenager Jessica Sanchez in record viewer voting. He was the fifth male "Idol" winner in a row.

Phillips, 21, a pawn shop worker from Leesburg, Ga., looked stunned when host Ryan Seacrest announced his name, then wordlessly accepted a hug from Sanchez and congratulations from his fellow finalists.

He dissolved into tears as he sang "Home," the song that may be his first single.

Phillips retained his humble, self-effacing demeanor to the end, and beyond.

"I have no idea why I won, man," he said in his backstage dressing room. "I guess some people liked the music that I was doing. I'm just lucky. ... I was just doing my thing each week."

He received the winning share of the record-high 132 million votes cast after Tuesday's final showdown with high school student Sanchez, 16, of Chula Vista, Calif. The vote count was not announced, typical for the contest.

His victory extended the "American Idol" winning streak for men to five consecutive seasons. The last female to win, and the last non-white, was Jordin Sparks in 2007.

Phillips has more in common with the last four winners than gender. Like them, he is a young Caucasian guitar player, also known to "Idol" watchers as WGWGs ? white guys with guitars.

Last year's winner was Scotty McCreery, preceded by Lee DeWyze, Kris Allen and David Cook.

Sanchez, who is of Filipino and Latino heritage, took a measured view of the outcome, one that she said had solely to do with music.

"I don't blame it on anything," she said backstage. "Phillip has his fans, and I have mine. We're totally two different people. Our genres are completely different.

"He's more like the indie, alternative rock kinda guy, and I'm more urban R&B pop. ... It's just the number of our fans," she said, adding that she expected to be the runner-up.

"In the moment, I told him, 'You're gonna win this.' I was smiling at him the whole time. I was ready to just give him a big hug, and that's what I did when they announced it."

Sparks, 22, was among the guest stars who helped fill out the two-hour finale show, among them Rihanna, Neil Diamond, Reba McEntire, Chaka Khan and John Fogarty. "American Idol" judges Steven Tyler, with his band Aerosmith, and Jennifer Lopez also performed, but it was Sanchez and Jennifer Holliday who stood out with a powerhouse duet on "And I'm Telling You I'm Not Going."

Besides music, there was a marriage proposal for the season 11 finale: Former contestants Ace Young and Diana DeGarmo got engaged on stage.

Young, 31, a season five finalist, told Seacrest that he and DeGarmo, 24, had just moved in together. Then Young got down on one knee and popped the question to her.

"I love you to death. You're my best friend," Young said in his proposal, which included a jarring credit for the jeweler who made the engagement ring he was offering (which, given Fox's heavy soft drink and car sponsor product placement, wasn't so off-key).

DeGarmo, a runner-up in season three, tearfully accepted, her head bobbing up and down.

But the point of the finale, saved for the final minutes and the highest possible ratings, was anointing the newest Idol and winner of a record contract.

During the three-song showdown Tuesday between Phillips and Sanchez, the show's judges praised his performance across the board. Sanchez was faulted for a lackluster rendition of her third song, "Change Nothing."

Although some critics dismissed Phillips as a Dave Matthews clone, viewers embraced him for his humility, his on-camera mugging and his memorable acoustic covers of songs like Usher's "U Got It Bad." In weekly tallies, Phillips never fell among the low vote-getters.

On Tuesday, he earned consistently high marks from the show's judges, while Sanchez faltered on "Change Nothing," the song that could serve as her first release.

The teenager agreed with panelists Randy Jackson, Lopez and Tyler, saying she should have gone more "urban" with her song choice.

Phillips had better luck with the slow-tempo, acoustic tune "Home," which the judges said recalled artists like Fleet Foxes, Paul Simon and Mumford and Sons. At one point during Phillips' final performance, the pawn shop worker was accompanied by a marching band.

It was a hit with the panel. Jackson, beaming, exclaimed: "I love the song. I love you. I love the production. I love the marching band. Everything about that was perfect."

Last year's contest between McCreery and runner-up Lauren Alaina drew more than 122 million votes, the record that was broken Wednesday.

That's the great surprise about it," Coyne said. Fund a business with retirement savings: Employee Stock Purchase ...

I?ve accepted it: Retirement is dead. Anyone still working today might never be able to retire.

So why are we all putting money into retirement savings accounts? ?Between IRAs, ROTHs, 401(k)s, SIMPLEs, SEPs and SOLOs, there?s no shortage of ways to save for a day that may never arrive. ?And yet Morningstar reports that the average retirement account lost value last year! ?(Mine certainly did!)

Here?s a better retirement plan: Stop Saving and Start Building. ?

Increasingly, entrepreneurs are tapping their retirement accounts to build a company that will enrich their life now and later. ?By building wealth and long-term income rather than savings, business owners are using their creative and productive years to the fullest ? multiplying their wealth themselves rather than worrying about the ups and downs of the stock market.

If you have an IRA or a 401(k), there is now a way for you to use retirement savings to fund your business growth ? or even start a new business. ?Turn your retirement account inside-out and put that money to use!

Qualified Employee Stock Purchase Plan ? offered through a corporate 401(k). ?That?s the heart of this transaction, but there?s more to it than that. ?A good intermediary will assist you with corporate issues too, including creating and maintaining the correct form of corporation, a private placement memo and ?Regulation D Rule 506? compliance, ERISA compliance, corporate filings, tax filings, 401(k) administration and accounting.

Starting to sound complicated? ?A good intermediary will make it simple. ?Do not attempt this alone ? it takes a practiced securities attorney to do it right and a ?plan administrator? is required by law to maintain the retirement accounts.

Practically speaking, you should have a minimum of $50,000 in current retirement accounts. You can do less, but it may not be cost effective because there are fees to setup and maintain these accounts: ?There?s a flat fee for the upfront legal work and filing fees. (This can vary, but expect $5,000 or so.) ?There is also an annual plan administrator fee (Typically $1,000 per year).

There is no hard limit to the amount you can convert. ?Do you have half a million? ?Access it all if you want.

Once your current retirement accounts are transferred into the new corporate account (technically its a rollover, just like any other retirement rollover), you can use the money for whatever you need ? salaries, vehicles, land, buildings? any legitimate business purpose.

In fact, since this is a roll-over, you may be able to consolidate all your retirement accounts into the new plan, use what you need for the business, and keep the balance invested in whatever you want.

BONUS: ?When your business makes money, you can begin to put pretax money back into the 401(k) plan. ?So a well-crafted plan provides both a source of funding for your business now and a tax shelter later.

Console Innovation Is Past Due - Gentlemen of Gaming

The AP posted this story today outlining the state of the video game industry - and from looking at the list things aren't going so well. Company after company, from EA to Microsoft to Nintendo to Sony, are showing decreased revenues and/or losses from core video game products and services.

I'm far from a financial or industry expert, but it seems to me that the industry (particularly the console gaming industry) has been milking the cash cows of the current platforms for far too long and it's starting to catch up with them. The Wii, PS3 and XBOX 360 are very old by video game standards and the games themselves are starting be hamstrung by their aging technology. And most people who were ever going to buy one of these consoles has probably already done so - new products like the XBOX 360 Kinect notwithstanding.

But the software companies can't lay all the blame on the consoles either. I've gone on at length about my disappointments with EA, but they aren't the only company dropping the ball. Take-Two Interactive pushed back the release of BioShock Infinite from October 2012 to the end of February 2013 and took a 6% hit in stock price. And Activision Blizzard Inc. is showing lower revenue for their games as well - which isn't surprising considering their yearly Call of Duty releases are practically indistinguishable from each other.

Add all of this to the fact that games on platforms like the new iPad are increasingly more beautiful and engaging, and the console/traditional video game industry looks like it's in trouble. I understand why in a down-economy companies like Microsoft, Sony and Nintendo decided to stick with the current consoles and only make iterative improvements. But if they want to succeed in the future, the time to come up with some real innovation is now.

Ore. workers awarded $332K in onsite toilet fight

(AP) ? Two workers who claimed they were forced to urinate in a bucket have been awarded $332,000 after a jury found they were fired for complaining to Oregon regulators about the lack of an onsite toilet.

The Oregonian reports (http://is.gd/2gtxb5 ) that Douglas Eki and Xerxes "Jason" Doctolero told the state Occupational Safety and Health Division that they used the bucket because they couldn't get to a toilet fast enough.

They testified that their employer, Menzies Aviation, refused to provide them with a toilet and that using the restrooms of nearby businesses wasn't a solution because they were not welcome. The men performed mechanical work at Portland International Airport.

The state agency cited the company in August 2010 for failing to provide restrooms. The men were fired later that month.

A company lawyer contended the men were fired because they kept using the bucket after being told not to.

According to the FBI?s Internet Crime Complaint Center (IC3), internet scams including identity theft, romance and advance free fraud have cost the U.S. over $450M USD in 2011, and those figures only account for reported crimes.? It is estimated 80% of such crimes go unreported.

Most common scam targeting Americans is cyber criminals approaching internet users on social networking sites and online dating sites, trying to be your ?friend? or gain your confidence.? Once they have an open line of communication, they can usually proceed to steal your identity, or money.?? The combinations and approaches used are endless, and anyone can be a victim.? In some cases the red flags are easy to spot, in other cases it may only take clicking on a link.?

Online shopping is also a main concern of internet security for the American government, the FBI and international investigators, as millions of emails are sent everyday offering victims bargains and deals that seem confusingly legit and authentic.? All it takes is a click on a bad link, or a visit to the wrong website and your computer maybe downloading a virus to take your passwords.

Overpayment fraud is a big concern now-a-days as victims get a check with instructions to deposit it in a bank account and send excess funds or a percentage of the money back to the sender. Private investigators explain that if caught, the sender (usually the victim) could also be charged in the scam, even though he was not aware of the crime he was committing when sending funds.

SpaceX Launches Private Capsule on Historic Trip to Space Station

CAPE CANAVERAL, Fla. ? A private space capsule called Dragon soared into the predawn sky Tuesday, riding a pillar of flame like its beastly namesake on a history-making trip to the International Space Station.

The unmanned capsule, built by billionaire entrepreneur Elon Musk's Space Exploration Technologies Corp. (SpaceX), is the first non-governmental spacecraft to launch to the space station, ushering in a new era of partnership between the public and private spaceflight programs.

"I think this is an example of American entrepreneurship at its best," said Alan Lindenmoyer, manager of NASA's commercial crew and cargo program, in a briefing before the launch. About 100 VIP guests were on hand to witness the launch, NASA officials said.?

The Hawthorne, Calif.-based SpaceX launched its Dragon capsule at 3:44 a.m. EDT (0744 GMT) today (May 22) from a pad here at the Cape Canaveral Air Force Station. It blasted off atop SpaceX's Falcon 9 rocket, a 157-foot (48-meter) booster powered by nine Merlin rocket engines.?The space station was flying 249 miles above the North Atlantic Ocean as the rocket lifted off, NASA officials said.?[Launch Photos: SpaceX's Dragon Blasts Off for Space Station]

Private spaceship in orbit

The gumdrop-shaped capsule is 14.4 feet tall (4.4 meters) and 12 feet wide (3.7 m), and packed with 1,014 pounds (460 kilograms) of cargo for the space station, including 674 pounds (306 kg) of food and supplies for the crew, as well as student-designed science experiments and a laptop computer.

The Falcon 9 rocket's second stage is also reportedly carrying ashes from 308 people, including actor James Doohan, who played Scotty on the 1960s television series "Star Trek," and Mercury program astronaut Gordon Cooper. The ashes were flown under a deal with the "memorial spaceflight" company Celestis, according to ABC News and Reuters.

The SpaceX launch vehicle is named after the Millennium Falcon of "Star Wars," while the capsule got its moniker from the Peter, Paul and Mary song, "Puff, the Magic Dragon."

Today marked only the second-ever launch of a Dragon capsule, and the third flight for the Falcon 9 rocket. It was the second attempt to launch the space station-bound test flight after a launch try Saturday was thwarted by a faulty rocket engine valve. Repairs were made over the weekend, and the SpaceX team counted down smoothly to the liftoff this morning.

"One thing that they are very good at is being able to work through launch abort and treat those problems and be prepared to go again in a very short time," Mike Horkachuck, NASA project executive for SpaceX, said Monday (May 21).

Today's launch is the last planned test flight for SpaceX under NASA's Commercial Orbital Transportation Services (COTS) program intended to develop a private-sector replacement for the cargo-delivery services of the retired space shuttles. SpaceX has a $1.6 billion contract to fly at least 12 unmanned missions to the space station through 2015.

Musk founded SpaceX in 2002 with the goal of boosting commercial access to space and, ultimately, aiming for deep-space exploration, including missions to Mars. The success of today's launch was never certain or assured, Musk had repeatedly said.

Today, the mission's uncertainty eased up a bit, he said.

"Falcon flew perfectly!!" Musk wrote in a Twitter post from Falcon 9's mission control room in Hawthorne. "Dragon in orbit, comm locked and solar arrays active!! Feels like a giant weight just came off my back."

Orbital catch up

The spacecraft is due to spend its first day on orbit catching up with the 240-mile high (390 km) space station, where it will rendezvous Thursday (May 24) and perform a fly-by to within 1.5 miles (2.5 kilometers) to check its navigation systems.?[Quiz: How Well Do You Know SpaceX's Dragon?]

On Friday (May 25), the capsule is slated to perform a series of maneuvers to approach the station, with crewmembers onboard the outpost issuing commands to Dragon. If the spacecraft passes a set of "go-no go" checks at Mission Control in Houston, NASA will approve the vehicle to approach the International Space Station. From inside, astronauts Don Pettit and Andre Kuipers will use the lab's robotic arm to grab Dragon and berth it to the station's Harmony node.

The hatches between the two spacecraft are due to be opened early Saturday (May 26), so the crew can enter Dragon and unpack its deliveries.

Dragon is due to spend about a week and a half attached to the outpost. On May 31, the capsule will be packed with completed science experiments and other equipment, unberthed, and sent back toward Earth. The vehicle is equipped with a heat shield to withstand the fires of re-entry, and is due to splash down and be recovered by ship in the Pacific Ocean.

Private spaceflight reality

Dragon is an unmanned version of a capsule ultimately intended to carry people as well.

Another company, Orbital Sciences Corp. of Dulles, Va., also has a NASA contract to deliver cargo to the space station, and plans to launch its first test flight later this year.

The program is part of a larger effort by NASA to outsource low-Earth orbit transportation to the private sector, allowing the space agency to begin work on a new spacecraft and heavy-lift rocket to visit asteroids, the moon and Mars.

The plan has received criticism from some lawmakers and members of the public, who worry that commercial vehicles aren't as safe or reliable as NASA's in-house built spacecraft.

"It's really easy to criticize, and it's very difficult to solve a problem and actually do something," said SpaceX president Gwynne Shotwell. "So I tend to focus on the business and getting our jobs done and not focus on those that want to criticize."

NASA officials and leaders of the commercial space sector say the time is right for space to transition from an exclusively government regime to an arena open to private companies.

"I kind of see that transition as being inevitable," said Phil McAlister, NASA's director of Commercial Spaceflight Development. "I believe it is going to happen at some point. If it's not today and this mission falls short of expectations, it is going to happen eventually."

Wade, Heat move on after Game 3 spat

INDIANAPOLIS (AP) ? Refreshed in body and spirit, the Miami Heat returned to practice reunited and refocused.

Spoelstra knows the dispute didn't look good to the outside world, but it's just part of professional sports.

"Your communication sometimes is not for everybody's living room, but it's normal in our living room," he said. "We've moved well beyond that. Dwyane and I have been together for a long time, nine or 10 years. That's the least of our concerns the last two days."

With an aggressive approach on both ends of the floor, the Pacers have won the past two games to put the Heat in an unforeseen hole and place their title hopes in serious danger. A win on Sunday would put Indiana up 3-1 and send the panic meter to code red in south Florida.

James, though, believes the Heat can even the series.

"We're a confident bunch," the MVP said. "We've got a veteran ballclub. We didn't play well in Game 3, so we have an opportunity to go out and make amends and try to bring it back to our house with the series tied 2-2."

The Pacers expect Wade to be back on his game Sunday. Although he's struggling with leg issues, Wade is still one of the game's top players and has the ability to score in bunches. The most intense matchup in this series has been between James and Indiana's Danny Granger, who has not shied away from being physical with Miami's superstar.

Granger was called for a technical Thursday after he pulled James' jersey on a breakaway and then took exception to an elbow extended toward his face.

"That's part of basketball. That's two men battling," Granger said. "I'm not backing down from anybody, and he's not backing down from anybody. And when you get that, you get some altercations."

Vogel has preached all season for his players to have an "edge," but doesn't want them to do anything that could hurt the team.

"They understand very clearly that we are not interested in any ejection or suspension," he said. "They also understand very clearly that a key to this series is letting the Miami Heat know that we're not backing down from them."

Granger said he knows not to take things too far. The risks are too great.

"I know where the line is," Granger said. "(NBA commissioner) David Stern has done a good job of making sure we know what the line is and what not to cross. We won't cross that line. We just want each other to know it's going to be an intense battle, and it's going to be a fight."

James brushed aside Granger's tough-guy talk as an opponent playing mind games.

"Why would he be scared of me?" James said. "I'm not no monster and this ain't no horror movie. I'm not trying to scare anybody. He's hyping himself up to say he's not scared of me. Have I ever been intimidated by anybody in this league? I don't think so.

"I go out and play my game and let my game do the talking."
